A judge in New York has suspended the release of Herman Bell, a 70-year-old former member of the Black Liberation Army and a former Black Panther, who has been granted parole after spending 45 years in prison, and has been a victim of guards’ violence inside jail in 2017. ’The next date is April 13th, we’ll be in court. And hopefully, the earliest release date is April 17th, and we hope to welcome him home on that day or in one of the succeeding days’.

17 May 2018, by siawi3In transferring the Kathua trial out of Jammu and Kashmir, the apex court has conceded that communal polarisation has advanced so far in the state that a fair trial is no longer possible there. If the Supreme Court’s dismissal of the writ petitions requesting an independent investigation into Judge Loya’s death was a mistake, its decision to move the trial of the eight persons accused of raping and murdering an eight-year-old in Kathua out of the state of Jammu and Kashmir to Pathankot – although well-intentioned – is also a mistake. The move is well-intentioned, for its goal is to ensure a fair trial. But the apex court should have digged in its heels and insist that the state’s judiciary be first given the opportunity to rise above these contending pressures and give a fair and impartial judgment.

The Supreme Court last month refused to entertain a joint plea by six persons who sought compensation for their wrongful arrest in the Akshardham terror case from 2002. They were prosecuted and incarcerated for more than a decade and were acquitted some time ago by the same apex court.
